About the Mediation Process

Reserve a Date. To reserve a mediation date, we need the following information: 

  • Case name and venue
  • Attorneys’ names and contact information 
  • Agreement from all parties and counsel regarding the division of the mediation fee
  • Mediation date 
  • Suggested location of mediation

Mediation Location. Mr. Miner generally conducts mediations virtually via Zoom. However, Mr. Miner is more than happy to mediate at the law office of one of the attorneys handling the litigation. If the parties prefer an in-person mediation, and no office is acceptable or available, Mr. Miner will arrange for a neutral location to conduct the mediation at the cost of the parties. In virtual mediations, just like an in-person mediation, the parties will check in on the day of the mediation and the mediator will assign the parties to their own private breakout virtual conference rooms. The parties and counsel will need high-speed internet, a camera on their phone/computer, and to download the Zoom software. Before the mediation, we will email you the step-by-step instructions for joining the Zoom mediation. 

Mediation Fees.  Miner Mediation does not charge administrative fees and his below rates include all necessary review, research, phone calls and follow up:

  • $6,500.00 – Full Day Virtual/Zoom Mediation 
  • $3,250.00 – Half Day Virtual Mediation (total of four session hours)
  • $7,500.00 – Full Day In-Person Mediation 
  • $3,750.00 – Half Day In-Person Mediation (total of four session hours)

Mediation Briefs. Briefs should be submitted one week prior to the mediation date. Briefs should include a brief statement of relevant facts, the procedural background of the case, legal claims/arguments, damages evaluations, and any current settlement demands/offers. Please indicate whether the mediation brief is “confidential” (i.e., not to be shared with the other party).

Ultimate Decision Makers. Attendance by individuals with ultimate authority to settle the case is critical to the mediation process. All parties must have someone present who has the ultimate authority to settle the case. 

Payment and Cancellations. The mediation fee is due at least 21 days in advance of the hearing, unless the mediation is scheduled within the 21-day window and then please send immediately.  If payment is not received in advance of the mediation, the mediation is subject to cancellation.  The fee will be refunded if the hearing is cancelled 21 days or more before the scheduled date.  The fee is subject to forfeiture if the hearing is cancelled less than 21 days before the mediation, unless Miner Mediation can book another mediation on that date.
